General Terms and Conditions

1. GENERAL
1.1
These general terms and conditions ("General Terms") apply when you, as a consumer ("You" or "Customer"), place an order via www.giart.no. The agreement is concluded between you and GIART GEORGINE D. CETUSIC, organization number 929 427 920. The General Terms and Conditions only apply to Customers who are consumers.

1.2
You must be at least 18 years of age to order via the Website. According to Norwegian legislation, GIART via www.giart.no does not accept credit purchases for persons under the age of 18. GIART via www.giart.no reserves the right to reject or change your orders (for example, if you have provided incorrect personal information and/or have a history of non-payment of debts).

1.3
GIART via www.giart.no shall have no responsibility if products are sold out, nor for image or typographic errors on the Website, for example errors in the product description or the technical specification, inaccurate prices and price adjustments (such as changes in the price from suppliers, currency changes) or incorrect information about whether a product is in stock or not. GIART  has the right to correct such errors and at any time to change or update the information. If an incorrect price has been stated for a product you have ordered, GIART must of course inform you of this and wait for your approval of the changed price before GIART continues the ordering process. All images on the Website are to be considered illustrations only. Such illustrations are not guaranteed to represent the quantity of products you will receive or the product's exact appearance, function or origin. GIART is not responsible for information from third parties provided to the Website.

The website and all its content are owned by GIART or its licensors. The information is protected by intellectual property law and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout and information about products, services and other content are not permitted to be copied or used without prior written consent from GIART.

2. CONTRACTS AND ORDERS
2.1
To place an order through the Website, you must accept the General Terms and Conditions. By accepting the General Terms and Conditions, you promise to fully comply with the General Terms and Conditions and acknowledge that you have read the information on personal data and cookies and consent to use in accordance with GIART privacy guidelines , look here.

2.2
A purchase agreement is concluded when GIART  has confirmed your order, and you have received an order confirmation from www.giart.no via e-mail. GIART encourages you to keep the order confirmation for any future contacts with GIART customer service about the order. You have the right to cancel your order until it has been confirmed by GIART. If the order is cancelled, GIART  shall refund any payments you or your credit card company have made regarding the order.

3. CUSTOMER INFORMATION, ETC.
3.1
When you visit the website and have made a purchase, GIART handles your personal information, among other things, with the aim of offering you as good a website as possible and to be able to execute purchase agreements with you. You confirm that the information you fill in is correct and complete and that you are responsible for incorrect information. 4. PRICES, FEES AND PAYMENT
4.1
The prices stated on the Website apply to orders placed on the Website. All prices are stated in NOK and include VAT. The prices do not include payment and shipping fees, which are given separately.

4.2
You can pay for the purchase in the manner indicated on the Website. GIART has the right to debit you already in connection with the order if you have not chosen invoicing or a similar payment method, and this is accepted by GIART. When invoicing or partial payment, GIART  or its partners must be able to obtain credit information from third parties. In that case, you will be informed accordingly. GIART reserves the right at all times not to offer all payment methods, or to change the payment method if, for some reason, the payment method you have chosen does not work at the time of fulfillment for the fulfillment of the order. Please note that restrictions on available payment methods are indicated on the Website.

5. SPECIAL OFFER
GIART shall from time to time be able to come up with special offers on the Website that are more favorable than those contained in these General Terms and Conditions, for example regarding payment or extended right of withdrawal. Such conditions shall apply as long as the special offer lasts and for the specific products that GIART has specified in connection with this. GIART reserves the right to withdraw such special offers at any time. In the event of termination or withdrawal of a special offer, these General Terms and Conditions shall apply without any changes. Offers on specific products on the Website only apply for the limited period and until the products are sold out.

6. DELIVERY AND SHIPMENT
6.1
Products in stock are normally delivered within the number of working days indicated on the Website. Unless otherwise agreed (for example in connection with the reservation of products that are not in stock, special order of goods, or that you have chosen to collect your goods from stock in our physical store itself), delivery will take place no later than 30 working days after GIART has confirmed the order in writing in the order confirmation.

6.2
The expected delivery time is indicated in the order confirmation, at checkout and/or on the relevant product page on the Website. If there is a delivery delay, GIART will inform you of this and will continue to keep control of the order. Unless otherwise expressly agreed, and if a delivery is delayed by more than 30 working days and is not due to you as the Customer, you have the right to cancel the Purchase.

6.3
If a package is to be picked up at a specific delivery location, you must do so within the time period specified in the message. Parcels must normally be collected in person with valid identification and order number. You will receive a delivery notification stating when and where the package must be picked up or received. The message must be able to be given by e-mail, regular post, and if you have provided a mobile number, also via telephone or SMS.

7. RIGHT OF WITHDRAWAL
7.1

7.2
When products are purchased on the Website, you have a 14-day right of withdrawal in accordance with the applicable right of withdrawal act and consumer protection legislation. This means that you have the right to cancel any purchase by notifying GIART about this within 14 days from when you or your representative received the ordered product.



7.3
By accepting the General Terms and Conditions, you acknowledge and agree that the right of withdrawal does not apply to digital content delivered in any other way than on a movable medium.

7.4
In connection with ordering a product for which the right of withdrawal does not apply, you will receive clear information.

7.5
If you wish to use the right of withdrawal, you must, before the end of the withdrawal period, send a clear message to GIART. In the message, you must state your name, your address and other relevant information, for example the order reference, invoice number and the name of the product. You can use the standard form for the right of withdrawal issued by the Ministry for Children, Equality and Inclusion, see link here.

7.6
If you exercise your right of withdrawal, you must pay for the return shipping costs and are responsible for the condition of the product after you receive the product and during the return shipment. The product must be returned within 14 days from the date on which GIART received notification that you exercise the right of withdrawal. The product must be sent well packed, in good condition and in packaging that can withstand the post. Any returns must be returned to GIART in accordance with the methods and instructions provided on the Website. Cancellation form in pdf can be found HERE.

7.7
If you use the right of withdrawal, GIART shall refund the amount you have paid for the product including shipping costs to you. Any additional shipping costs due to you choosing a different delivery than the standard delivery GIART offers are excluded from the refund. When returning part of an order, shipping costs will not be refunded. GIART has the right to deduct an amount from the amount to be refunded corresponding to the depreciation of the product compared to the product's original value, if and to the extent that such depreciation is due to you having handled the product beyond what needed to determine its function or characteristics.

8. WARRANTY AND COMPLAINT
8.1
Some of GIART's goods may have a guarantee. Information on any warranty period and special warranty conditions for each item can be found on the website or in these terms and conditions. The warranty on goods only covers faults or defects that are due to manufacturing defects, and thus not faults that occur during or after the product's function and appearance have been changed, such as rebuilding, upgrading or other configuration of the product. Your order confirmation is valid as a guarantee certificate.

8.2
The right of complaint covers goods that are faulty in accordance with the Consumer Act. If you discover that the item is defective when you receive your order, you must contact GIART as soon as possible, but no later than 14 days after you receive your order. Contact via e-mail to giarts.no@gmail.com. Complaints made within two months after you discovered the fault are always considered to have been reported in time. You have a 2-year right to complain about goods purchased on the website. If you yourself are responsible for the product being defective, you cannot advertise.

8.3
GIART is responsible for the return shipping on approved claims.

8.4
When the claimed product is returned and the claim is approved, GIART  will compensate you in accordance with current consumer legislation. GIART does its best to ensure that this will happen within 30 days from GIART  receiving the complaint, but it may take longer depending on the nature of the item. GIART  reserves the right to reject a complaint if it turns out that the product does not have a fault that is covered by the Consumer Act. 9. WARRANTY AND COMPLAINTS
9.1
Some of GIART`s products may be subject to guarantees. Information on any warranty period and special provisions on warranties for each product are set out on the Website or in these General Terms and Conditions. Warranties for products shall only cover original manufacturing defects and, consequently, not possible faults that occur during or after possible, individual changes to the product's function and appearance, for example rebuilding, upgrading or other configuration of the product. The customer's order confirmation establishes the warranty certificate.

9.2
The right to complain applies to goods that are defective in accordance with the applicable consumer legislation. If you discover that the item is defective immediately after you have received it, you should contact GIART  by e-mail: giarts.no@gmail.com. Write to us within 14 days of receipt. Complaints that are reported within two months from when you discovered the error are considered to have been reported in time. You have the right to make a complaint about products purchased on the Website, within 2 years of receiving the product, or within five years if the product is intended to last significantly longer than two years in normal use.

9.3
GIART shall bear the costs of return shipping for any approved complaints.

9.4
As soon as a product about which a complaint has been lodged is returned and the complaint is accepted, GIART shall refund you in accordance with current consumer protection legislation. GIART endeavors to do this within 30 days after GIART has received the complaint, but this may be delayed depending on the type of product. GIART reserves the right to reject any complaint if the product according to current consumer protection legislation proves not to be defective. In connection with complaints, GIART complies with the guidelines given by the Consumer Complaint Committee.

10. LINKS
GIART shall be able to provide links to other websites outside GIART's control and websites outside GIART's control , must be able to provide links to the Website. Although GIART endeavors to ensure that GIART only provides links to websites that use similar personal data and security regulations as GIART  Privacy Policy, GIART is not responsible for possible protection or confidentiality regarding information or personal data you provide on other websites. You should exercise caution and read the privacy policy applicable to that website.

11. FORCE MAJEURE
GIART is not responsible for any delays caused by circumstances beyond GIART`s control, for example general labor disputes, acts of war, fire, lightning strikes, terrorist attacks, changed regulations from the authorities, technical problems, defects in power/telecommunications/computer communications or other communications and defects or delays in service from subcontractors due to conditions such as mentioned before. Such conditions shall lead to exceptions from compensation and other measures. Should such a situation arise, GIART shall inform you of the situation. If the situation has lasted for more than two months, both you and GIART have the right to cancel the purchase with immediate effect.

12. CHANGES IN THE GENERAL TERMS
GIART reserves the right to change these General Terms and Conditions at any time. Any changes to these General Terms and Conditions must be published on the Website. Changes will apply as soon as you have accepted the General Terms and Conditions (in connection with a new purchase, or while he/she is viewing the Website), possibly 30 days after GIART has informed you of the changes . But GIART recommends that you regularly keep up to date on the Website to become aware of possible changes to the General Terms and Conditions.

13. EXCLUSION
If a competent court, authority or arbitral tribunal deems any provision of this Agreement invalid or unenforceable, the remainder of that provision and all other provisions shall remain valid and enforceable to the extent permitted by applicable law. Any provisions determined to be invalid or unenforceable shall be replaced with relevant legal guidance and advice.

14. APPLICABLE LAW AND DISPUTE RESOLUTIONS
14.1
Any dispute that may arise must be resolved amicably through discussions with GIART's customer service. If an amicable solution cannot be achieved, GIART  shall abide by the decisions of the Consumer Complaint Committee or equivalent authority in other European countries.

14.2
Any dispute regarding the interpretation or application of these General Terms and Conditions shall be governed by and interpreted in accordance with Norwegian legislation and shall be decided exclusively by the courts in Norway.
